Terms of Service

These terms govern your use of Nighty Night, a service operated by Overarching AI LLC("Nighty Night," "we," "us," or "our") through our web app (nightynight.ai) and mobile apps. By creating an account or using the service, you agree to these terms. If you don't agree, please don't use Nighty Night.
1. Who can use Nighty Night
Nighty Night is a tool for parents and guardians to create personalized stories for their children. You must be at least 18 years old, or the age of majority where you live, to create an account. There is no way for a child to sign up, sign in, or use the service directly — every profile and story is created by the adult account holder. See our Privacy Policy for more on how child profile information is handled.
2. Your account
You're responsible for keeping your account credentials secure and for anything that happens under your account. Let us know right away at [email protected] if you suspect unauthorized access.
3. Subscriptions, credits, and billing
New accounts get a limited number of free stories. Beyond that, Nighty Night offers a Premium subscription (billed monthly or annually) that renews automatically until canceled, plus one-time top-up credit packs that never expire. Current pricing is always shown in the app before you pay.
- Renewal. Subscriptions renew automatically at the end of each billing period unless canceled beforehand.
- Cancellation. Cancel anytime from your Account page (web) or, if you subscribed through the iOS app, from your Apple ID subscription settings — canceling keeps your access and remaining credits through the end of the period you already paid for.
- Payment processing. Web subscriptions are billed by Stripe; iOS subscriptions are billed by Apple through StoreKit. We never see or store your card details — see Section 4 of our Privacy Policy.
- Refunds. Purchases made on iOS are refunded by Apple under their own policies — contact Apple support for those. For web purchases, email [email protected]and we'll do our best to help.
4. Content you provide, and content we generate
What you provide.You're responsible for anything you type into Nighty Night — a child's nickname, appearance details, story prompts, and similar input. Don't submit anything unlawful, someone else's private information without their permission, or content that violates another person's rights.
What we generate. Nighty Night uses AI (see our Privacy Policy for which providers) to write, illustrate, and narrate a story from your input. Generated stories are fictional, may not always be perfectly consistent, and aren't reviewed by a person before they're shown to you — though every story does pass through automated safety checks (see our Security page) and can be reported for human review at any time.
Who owns a generated story.As between you and us, you own the specific story, illustrations, and narration generated for your family, and you're free to keep, share, or gift it as you like. We retain the right to store, reproduce, and process it as needed to operate the service (for example, to keep it in your library, generate the page images and audio, or send it as a gift link you create). We don't claim ownership of your child's nickname, prompts, or other input, and we don't use your family's content to train AI models beyond what's needed for our providers to generate that story back to you.
Our own content.Everything else about Nighty Night — the app itself, its design, and the Nighty Night name and logo — belongs to Overarching AI LLC, and these terms don't grant you any rights to it beyond normal use of the service.
5. Acceptable use
You agree not to:
- Use Nighty Night to generate or attempt to generate content that's unsafe or inappropriate for a child, or to try to circumvent our safety checks.
- Use the service for anything unlawful, or in a way that infringes someone else's rights.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the service or its underlying systems.
- Resell or redistribute the service itself (sharing an individual gift link with a story's intended recipient is fine).
We can suspend or terminate an account that violates these terms, especially anything involving unsafe content directed at a child.
6. Disclaimers
Nighty Night is provided "as is." We work hard to make every story safe and enjoyable, but AI-generated content can be unpredictable — we don't guarantee that every story will be free of errors or exactly what you expected, and we make no warranties, express or implied, about the service beyond what the law requires.
7. Limitation of liability
To the fullest extent the law allows, Overarching AI LLC isn't liable for indirect, incidental, or consequential damages arising from your use of Nighty Night, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
8. Ending your use
You can stop using Nighty Night and delete your account at any time — see your Account page or email [email protected]. We may suspend or terminate your access for violating these terms, using the service unlawfully, or non-payment.
9. Changes to these terms
If we make a material change to these terms, we'll update the "Last updated" date above and, for significant changes, notify you by email or an in-app notice. Continuing to use Nighty Night after a change takes effect means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the United States, without regard to conflict-of-law rules.
